"The case refers to Samyak Misra, who had booked a flat in Indirapuram Supertech Icon site in December 2006 and made full payment on January 18, 2007. Supertech promised possession of flat within two years of receipt of full payment failing which the builder company promised to pay an interest of 18 percent annually for the period of delay. "
New Delhi, May 22 - The Noida District Consumer Forum has ordered arrest of directors of real estate company Supertech for non-compliance of its order in a consumer complaint.

In its execution order, the Gautam Buddh Nagar district consumer forum has asked the Senior Superintendent Police, Noida, to present directors of the company before the forum on June 27.

The arrest warrants being bailable, directors can get bail by giving bail bond of Rs.10,000 only. The order was issued Wednesday.

The consumer forum ordered the arrest of Supertech directors after the company failed to comply with the forum's order to pay the due amount.

The company's legal representatives have repeatedly promised the forum in last one month that payment would be done at the next date but the forum's repeated persuasion failed to produce any result, compelling the forum to issue bailable warrants of arrest.

The case refers to Samyak Misra, who had booked a flat in Indirapuram Supertech Icon site in December 2006 and made full payment on January 18, 2007. Supertech promised possession of flat within two years of receipt of full payment failing which the builder company promised to pay an interest of 18 percent annually for the period of delay.

The possession offer was made in February 2010 which meant a delay of 13 months but the company refused to pay the penalty for delay. The consumer approached the Gautam Buddh Nagar District Consumer Forum in September 2010 and it awarded the consumer an interest of 12 percent per annum for the period of delay till the possession of the flat.
